1934 Indenture: Jeremiah Henry Long and Thomas Murray

This Indenture made the eighteenth day of December One thousand nine hundred and thirty four between of Youghal in the County of Cork Merchant of the one part and Thomas Murray of the Hollies Knockaverry Youghal aforesaid Builder and Contractor of the other part

Whereas by indenture of Lease dated twenty ninth day of February One thousand eight hundred and forty eight made between Thomas Murdock Green of the one part and Jeremiah Long of the other part all that part of the lands of Knockaverry therein more particularly described and part of which is intended to be hereby assigned was demised to said Jeremiah Long for a term of three hundred years from the twenty fifth day of March One thousand eight hundred and forty seven subject to the yearly rent of eight pounds therein reserved and to the covenants by the lessee therein contained

And Whereas by divers means assignments acts in the law and events and ultimately by an indenture of assignment dated twenty fourth day of January One thousand nine hundred and twenty nine made between Richard William Long of the first part Joseph Holmes of the second part said Joseph Holmes of the third part John M Torrens of the fourth part Robert Gordon Torrens of the fifth part Elizabeth Martha Brookes of the sixth part and Elizabeth Martha Brooks of the seventh part Thomas Rickerby of the eighth part and said Jeremiah Henry Long of the ninth part inter alia all the estate and interest of the Lessee under said recited lease in the premises hereinafter described and intended to be hereby assigned became vested in the said Jeremiah Henry Long

And Whereas by indenture bearing equal date with the last mentioned Indenture made between the said Richard William Long of the first part the said Joseph Holmes of the second part the said John M Torrens of the third part the said Robert Gordon Torrens of the fourth part the said Elizabeth Martha Brookes of the fifth part the said Elizabeth Martha Brookes of the sixth part the said Thomas Rickerby of the seventh part the said Jeremiah Henry Long of the eighth part and the said Joseph Holmes of the ninth part the houses and premises known as numbers three four five and six Gibraltar Terrace Youghal aforesaid being portion of the premises comprised in said recited Lease were assigned to said Joseph Holmes

Subject to the entire of said yearly rent of Eight pounds reserved by said recited Lease in exoneration and indemnification of all other premises liable thereto (including the premises hereby assured)

And Whereas the said Jeremiah Henry Long has agreed with the said Thomas Murray for the sale to him for the sum of Two hundred pounds of the dwellinghouse and premises thereinafter particularly described and delineated and coloured red on the map hereon indorsed and also the triangular plot of ground situate at Knockaverry aforesaid thereinafter more particularly described and delineated and coloured blue on the map hereon indorsed

Subject to the rent and covenants in said recited lease contained but indemnified against said rent and every part thereof by the premises known as numbers three four five and six Gibraltar Terrace Youghal as aforesaid

NOW THIS INDENTURE WITNESSETH that in pursuance of said agreement and in consideration of the said sum of Two hundred pounds now in hand paid by the said Thomas Murray to the said Jeremiah Henry Long (the receipt whereof the said the said Jeremiah Henry Long doth hereby acknowledge) he the said Jeremiah Henry Long as Beneficial Owner DOTH hereby ASSIGN unto the said Thomas Murray FIRSTLY ALL THAT dwellinghouse and premises with the appurtenances known as Knockaverry Cottage as delineated and described in the Map hereon endorsed and thereon coloured red AND SECONDLY ALL THAT triangular plot of ground also delineated and described in the map hereon endorsed and thereon coloured blue and which said premises hereby firstly and secondly described are situate in the Townland of Knockaverry in the Urban district of Youghal Parish of Saint Marys Barony of Imokilly and County of Cork TO HOLD the said premises hereby firstly and secondly assigned unto the said Thomas Murray his executors administrators and assigns for the residue of the term of three hundred years granted by said recited Lease subject to the covenants (other than the covenant for payment of rent) and conditions herein contained so far as same relate to the premises hereby assigned with the full benefit of the indemnity created by said recited Indenture dated Twenty fourth January One thousand nine hundred and twenty nine made between Richard William Long of the first part said Joseph Holmes of the second part said John M Torrens of the third part said Robert Gordon Torrens of the fourth part said Elizabeth Martha Brookes of the fifth part the said Elizabeth Martha Brookes of the sixth part the said Thomas Rickerby of the seventh part the said Jeremiah Henry Long of the eighth part and the said Joseph Holmes of the ninth part AND Subject to the right of all persons entitled thereto to pass and repass on foot along the existing footways situated and described on the map hereon endorsed by the dotted lines thereon

AND THIS INDENTURE ALSO WITNESSETH that in further pursuance of said ??? and for the consideration aforesaid the said Jeremiah Henry Long doth hereby assign unto said Thomas Murray such estate and interest (if any) as the said Jeremiah Henry Long has in the Ash Pit at Knockavenny aforesaid and at the North East corner of the premises hereby secondly assigned and which is delineated and coloured yellow on the Map endorsed hereon to Hold unto the said Thomas Murray his executors administrators and assigns for the residue of the term granted by said Lease and the said Thomas Murray hereby covenants with the said Jeremiah Henry Long that he the said Thomas Murray his executors administrators and assigns will henceforth observe and perform the covenants on the part of th Lessee (other than the covenant for payment of rent) and conditions in the said recited Indenture of Lease contained so far as the same relate to the premises hereby assigned and will keep the said Jeremiah Henry Long his heirs executors administrators and his and their estates and effects fully indemnified against all claims and demands for or in respect of the breach of the said covenants and conditions so far as the same relate as aforesaid AND the said Jeremiah Henry Long hereby acknowledges the right of the said Thomas Murray to the production of the seven documents mentioned on the schedule hereto (the possession of which is retained by the said Jeremiah Henry Long) and to delivery of copies thereof and hereby undertaken with the said Thomas Murray for the safe custody of the same documents AND it is hereby certified that the transaction hereby effected does not form part of a larger transaction or of a series of transactions in respect of which the amount or value or the aggregate amount or value of the consideration or of the property conveyed or transferred exceeds five hundred pounds.
